Unless otherwise stated in writing, all purchases are final and non-refundable.

If a separate written agreement, checkout page, invoice, event registration page, payment page, signed document, guarantee, refund policy, or event-specific agreement contains additional or different payment terms, those terms will apply to that specific purchase, event, program, or service.

We reserve the right to change pricing, payment options, program details, offers, discounts, bonuses, guarantees, or availability at any time.

Failure to complete payment obligations may result in suspension or termination of access to services, programs, events, communities, content, or other benefits.

 

11. Event-Specific Agreements, Waivers, and Guarantees

Certain Men of Means events, retreats, workshops, trainings, trips, adventures, programs, memberships, coaching services, or paid offerings may have their own written agreements, terms, conditions, guarantees, disclaimers, refund policies, release forms, participation requirements, or liability waivers.

Those event-specific or program-specific agreements may include terms related to:

  • Payment obligations

  • Refunds or no-refund policies

  • Guarantees or guarantee limitations

  • Cancellation terms

  • Travel requirements

  • Health and safety requirements

  • Assumption of risk

If there is any conflict between these general Terms and a separate written agreement, signed agreement, event-specific agreement, waiver, release, guarantee, registration term, checkout term, or program-specific document, the separate or event-specific document will control for that specific event, program, purchase, service, guarantee, or offering.

Men of Means may require participants to review, agree to, or sign additional documents before participating in certain events, retreats, trips, workshops, programs, adventures, communities, or services. We may deny or cancel participation if a required agreement, waiver, release, or acknowledgment is not completed.

 

12. Program Changes and Availability

Men of Means may modify the structure, schedule, format, location, curriculum, speakers, facilitators, bonuses, benefits, features, or delivery method of any program, event, training, coaching service, community, or offering at any time.

We may make changes due to business needs, operational reasons, speaker availability, venue changes, technical issues, safety concerns, legal requirements, market conditions, low enrollment, scheduling conflicts, weather, travel issues, illness, force majeure events, or other circumstances.

We do not guarantee that any specific service, event, program, speaker, feature, location, format, bonus, benefit, guarantee, or offer will remain available indefinitely.

When reasonable, we will attempt to provide appropriate updates or substitutions, but we reserve the right to make changes in our sole discretion.

 

13. Intellectual Property

All Men of Means content, materials, methods, frameworks, teachings, language, concepts, names, phrases, videos, audio recordings, written materials, graphics, logos, designs, event materials, program materials, training materials, website content, downloads, worksheets, recordings, and other intellectual property are owned by or licensed to Men of Means.

You may not copy, reproduce, modify, adapt, distribute, sell, publish, display, perform, share, teach, license, transfer, create derivative works from, or commercially exploit any Men of Means content without our prior written permission.

Participation in any Men of Means event, program, coaching relationship, training, community, or service does not give you ownership rights in any Men of Means intellectual property.

You may use Men of Means content only for your own personal, non-commercial use unless we expressly authorize otherwise in writing.

 

14. Recordings, Media, and Event Participation

Men of Means events, programs, calls, workshops, webinars, trainings, coaching sessions, community gatherings, and related experiences may be recorded, photographed, livestreamed, transcribed, summarized, or otherwise documented.

By participating, you acknowledge and agree that Men of Means may capture, use, store, edit, publish, display, distribute, or repurpose recordings, images, video, audio, transcripts, chat messages, comments, testimonials, or other content from events or programs for business, educational, promotional, archival, internal, marketing, training, or operational purposes, unless otherwise prohibited by law or agreed in writing.

If you do not wish to be recorded or photographed, you are responsible for notifying us in writing before participating and avoiding areas, sessions, or formats where recording may occur.

We reserve the right to use recordings and related materials in a manner consistent with our Privacy Policy, any applicable event-specific agreement, and applicable law.

 

15. Testimonials and Feedback

If you provide testimonials, feedback, reviews, comments, survey responses, social media posts, messages, or other statements about Men of Means, you grant us the right to use, edit, reproduce, publish, display, distribute, and share that content for marketing, promotional, educational, internal, or business purposes, unless you clearly notify us otherwise in writing.

We may use your first name, business name, likeness, general location, title, or other identifying details you provide, subject to applicable law and our Privacy Policy.

You represent that any feedback or testimonial you provide is truthful and based on your actual experience.

 

16. No Professional Advice

Men of Means content, coaching, programs, events, trainings, communications, and materials are provided for educational, informational, personal development, professional development, leadership development, business development, networking, and community purposes only.

Nothing provided by Men of Means should be considered legal, financial, investment, tax, medical, psychological, psychiatric, mental health, therapeutic, religious, or other licensed professional advice.

You are solely responsible for your own decisions, actions, interpretations, results, health, finances, business choices, relationships, and personal outcomes.

You should consult qualified professionals before making decisions that require professional advice.

 

17. No Guarantees and Results Disclaimer

Men of Means may share ideas, teachings, stories, frameworks, strategies, examples, testimonials, case studies, or experiences related to personal growth, business growth, leadership, emotional development, spirituality, communication, sales, relationships, community, or other areas of life and business.

Except where a separate written guarantee is expressly provided for a specific product, program, service, or event, we do not guarantee any specific outcome, result, income, revenue, profit, personal transformation, business growth, relationship improvement, spiritual experience, emotional breakthrough, client acquisition, sales performance, investment result, health outcome, or other result.

Any testimonials, examples, or stories are not guarantees that you will experience the same or similar results.

You agree that Men of Means is not responsible for your success, failure, decisions, actions, or outcomes.

18. Community Standards and User Conduct

You agree to engage with Men of Means, our team, our community, our events, and our services respectfully, lawfully, and in good faith.

  • Submit false, misleading, fraudulent, or deceptive information

This includes personal stories, business information, private conversations, coaching discussions, community discussions, program materials, strategies, methods, and non-public information.

Men of Means may remove or restrict any participant who violates confidentiality or trust within our programs or communities.

Our website and services may include links to, integrations with, or use of third-party websites, platforms, tools, payment processors, scheduling systems, communication platforms, video platforms, social media pages, analytics providers, email platforms, SMS platforms, CRM systems, or other external services.

We are not responsible for the content, privacy practices, terms, security, availability, performance, accuracy, actions, errors, or omissions of third-party websites, platforms, or services.

Your use of third-party platforms is governed by their own terms, privacy policies, and practices.

You voluntarily assume the risks associated with your participation in Men of Means programs, events, services, communities, coaching, trainings, conversations, exercises, travel, or related activities.

You are responsible for your own boundaries, choices, participation level, health, safety, decisions, and actions.

If you feel uncomfortable, unsafe, or uncertain about participating in any activity, you are responsible for pausing, opting out, seeking support, or consulting an appropriate professional.

Additional risks, assumptions of risk, releases, and liability waivers may apply to specific events, retreats, trips, adventures, workshops, or programs.

 

23. Release of Claims

To the fullest extent permitted by law, you agree to release Men of Means, its owners, officers, team members, contractors, partners, affiliates, representatives, speakers, facilitators, service providers, and agents from claims, liabilities, damages, losses, costs, expenses, or demands arising out of or related to your participation in our website, services, communications, programs, events, communities, coaching, trainings, or related activities.

This release includes claims related to personal decisions, business decisions, emotional responses, relationship outcomes, financial outcomes, professional outcomes, participation in events, reliance on information, communication issues, third-party services, or other experiences connected to Men of Means.

To the fullest extent permitted by law, our total liability for any claim shall not exceed the amount you paid directly to Men of Means for the specific product, service, event, or program giving rise to the claim during the three months before the claim arose.

If you have not paid Men of Means for the specific product, service, event, or program giving rise to the claim, our total liability shall not exceed $100.

Some jurisdictions do not allow certain limitations of liability, so this section applies only to the fullest extent permitted by applicable law.

 

26. Indemnification

You agree to indemnify, defend, and hold harmless Men of Means, its owners, officers, team members, contractors, partners, affiliates, representatives, speakers, facilitators, service providers, and agents from and against any claims, damages, liabilities, losses, costs, demands, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your participation in Men of Means offerings

  • Your violation of any law or regulation

  • Your violation of the rights of another person or entity

These may include acts of God, natural disasters, weather events, fires, floods, pandemics, illness, government actions, legal restrictions, labor disputes, supply issues, travel disruptions, venue issues, internet outages, power outages, technical failures, cyberattacks, payment processor outages, carrier delays, third-party platform failures, or other events beyond our reasonable control.

 

28. Governing Law

Except where an event-specific agreement, waiver, release, registration form, guarantee, refund policy, or mandatory local law provides otherwise, these Terms and any dispute, claim, or controversy arising out of or related to Men of Means, our website, services, programs, communications, products, purchases, memberships, intellectual property, online offerings, or business operations shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles.

For in-person events, retreats, trips, adventures, workshops, trainings, or experiences held outside the United States, you acknowledge that certain matters may be governed by the laws, rules, regulations, safety standards, venue requirements, travel rules, liability standards, or mandatory legal requirements of the country, state, province, territory, municipality, or location where the event takes place.

To the fullest extent permitted by law, Texas law shall continue to govern Men of Means’ general business terms, intellectual property rights, payment obligations, online services, digital content, membership terms, communications, and contractual relationship with you, unless a separate written agreement expressly states otherwise.

 

29. Venue and Jurisdiction

Except where an event-specific agreement, waiver, release, registration form, guarantee, refund policy, or mandatory local law provides otherwise, any dispute, claim, or legal proceeding arising out of or related to these Terms, Men of Means, our website, services, programs, communications, products, purchases, memberships, intellectual property, online offerings, or business operations shall be brought exclusively in the state or federal courts located in Travis County, Texas.

You consent to the personal jurisdiction of those courts and waive any objection to venue, inconvenient forum, or lack of personal jurisdiction to the fullest extent permitted by law.

For in-person events, retreats, trips, adventures, workshops, trainings, or experiences held outside the United States, claims involving bodily injury, property damage, venue incidents, travel incidents, safety issues, local service providers, local transportation, accommodations, activities, or other matters directly connected to the physical location of the event may be subject to the jurisdiction, venue, and mandatory laws of the location where the event occurs.

Men of Means may require participants to sign additional event-specific agreements, waivers, assumption-of-risk forms, releases of liability, travel acknowledgments, medical disclosures, emergency contact forms, confidentiality agreements, media releases, guarantees, refund acknowledgments, or other documents before participating in certain events, retreats, trips, adventures, workshops, trainings, or experiences.

If there is a conflict between these Terms and a signed event-specific agreement, the event-specific agreement will control for that specific event, activity, guarantee, refund term, liability issue, or participation requirement.

 

30. Dispute Resolution

Before filing any formal legal claim, you agree to first contact Men of Means at [email protected] and attempt to resolve the issue informally.

You agree to provide a written description of the issue, your contact information, the relief requested, and any relevant details.

Both you and Men of Means agree to make a reasonable good-faith effort to resolve disputes informally before pursuing formal proceedings.

To the fullest extent permitted by law, any claim must be brought individually and not as part of a class action, collective action, consolidated action, or representative proceeding.

 

31. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision will be interpreted or modified to the minimum extent necessary to make it enforceable while preserving the original intent as much as possible.

 

32. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

Men of Means may assign, transfer, or delegate its rights and obligations under these Terms at any time, including in connection with a merger, acquisition, restructuring, sale of assets, financing, transfer of business operations, or other business transaction.

 

34. Entire Agreement

These Terms, together with our Privacy Policy and any additional written agreements, checkout terms, registration terms, event terms, program agreements, waivers, guarantees, refund policies, releases, or signed documents, constitute the entire agreement between you and Men of Means regarding your use of our website, services, communications, programs, events, and offerings.

If there is a conflict between these Terms and a specific written agreement, signed agreement, checkout term, registration term, event agreement, program agreement, waiver, release, guarantee, or refund policy, the more specific document will control for that specific product, service, event, program, purchase, guarantee, refund term, liability issue, or participation requirement.
